Terms of Services

Effective date: 4th April 2025

Acceptance of terms

​By accessing or using Freeela, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the customer Service search, service provider feature, chat feature, rating feature and geo localization feature as provided by the Freeela application (Service).

Scope of the Services

We provide the following features as part of the Freeela Platform:​

  • Service Search by Category and budget

  • List service providers by category in your area, restricted to close radius from the original search request

  • List all service providers by rating and distance to origin

  • Communication via chat to provider and customer

  • Payment of service using STRIPE payment gateway

  • Creation of a personalised User Profile stating: Display Name, Full Name, Description, email.

  • Enable of Provider feature flag where any customer, if wish to do so, can also provide services

  • Payments processing pending acceptance of terms and conditions by the customer outlined in this document before payment is processed.

How are payments made for the service?

  • Freeela provides the customer with the choice on how to pay the services providers: cash or using a payment gateway.​

  • The application payment is handled by STRIPE payment gateway. Requirements to receive payments are restricted to Stripe requirements and failure to do so will disable any payment feature functionality. All personal data regarding stripe account creation are hosted in Stripe in accordance to local regulations, Freeela Services do not host or store any Personal Information regarding our user provider, banking or credit card information.   • Cash Payments: The Freeela platform is not responsible for any cash payments made between users. While the  platform allows for cash transactions, no cash is handled by Freeela in exchange for services between the parties involved.​

  • Taxation: Users are solely responsible for notifying the Australian Taxation Office (ATO) of any payments received through the platform. Freeela is not liable for any user's failure to report cash payments or fulfill their tax obligations.

  • Liability: Freeela is exempt from any liabilities arising from cash payments made as a result of services listed on  the platform. Users acknowledge that all cash transactions are conducted at their own risk and Freeela bears no  responsibility for any disputes, losses, or damages resulting from such transactions.

  • Service Transactions: Freeela does not mediate or guarantee the performance of services listed on the platform. Any agreements or disputes are strictly between the involved parties, and Freeela is not accountable for any  issues related to the fulfillment of these services.

  • Dispute Resolution: Users agree to resolve any disputes arising from cash payments or service transactions directly with the other party involved. Freeela will not act as a mediator or arbitrator in such disputes.

  • Compliance with Laws: Users must comply with all relevant laws and regulations, including taxation laws and right to work, when using the Freeela platform. 

  • Freeela is not responsible for any legal infringements or penalties incurred by users.

Service Quality

  • We are not responsible for and does not warrant the truth or accuracy of any aspect of services provided by the service providers to you, including but not limited to the quality of the services provided, or the honesty or accuracy of any information provided by the service providers, or the ability for the service provider to provide the services requested.​

  • Customer is responsable for any checks in regards to the service provider qualifications and/or insurance in regards to the service being requested. Freeela platform does not provide vetting nor does it hold any certifications and qualifications in our systems.​

  • Users acknowledge and agree that Freeela does not verify, and is not responsible for verifying, the qualifications, certifications, or insurance of service providers. Users are solely responsible for ensuring that providers meet all applicable legal and regulatory requirements before engaging their services.”​

  • Customers acting as a legitimate business must provide all the required information which will be validated by the Australian Business Register, any changes of circumstances need to be actioned by the respective business and communicated to the Australian Business Register. Freeela platform does not hold any responsability if information is misrepresented.

Refund of Fee

  • We are not responsible in issuing any refund of service fees The services provided by the service provider should be considered final, and any issues with the service fees and quality of service should be addressed directly with the service provider at the time of service.

Privacy Policy

  • Our Privacy Policy describes how we handle the information you provide to us when you use our services. You understand that through your use of our services, you consent to the collection and use of this information, including the transfer of this information for storage, processing, and use by Freeela. Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of Freeela

User Accounts

  • When you create an account with us, you must provide personal information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service. Information that must be accurate:

  • Full Name (First and Last Name)

  • Geo Location position (captured automatically by mobile gps location)

  • Valid email account

  • You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of Your account.

Business User Accounts​ and Content Generation

  • Freeela is not liable for the content submitted by businesses in their ad campaigns. However, Freeela provides reactive mechanisms for users to report inappropriate content, which will be reviewed by the Freeela Support team, and appropriate actions will be taken.

  • As an advertising platform, Freeela allows businesses to participate without requiring an ABN. However, it is the responsibility of the business to provide their ABN (or trading registration number) to Australian authorities.

Age Requirements

  • If you’re under the age required to manage your own Freeela account, you must have your parent or legal guardian’s permission to use a Freeela. Please have your parent or legal guardian read these terms with you.

  • If you’re a parent or legal guardian, and you allow your child to use the services, then these terms apply to you and you’re responsible for your child’s activity on the services.

Content

  • Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the service, including its legality, reliability, and appropriateness.

  • You may create and post Content related to businesses on Freeela, including but not limited to text, images, videos, and other materials. By doing so, you acknowledge that you are solely responsible for the Content you create, and you agree that you will not post any Content that violates the intellectual property rights, privacy rights, or any other rights of others.

  • In addition, you may have the option to tag businesses in your Content. By tagging a business, you are providing it with an opportunity to view and engage with your posted Content. Businesses on the Freeela platform reserve the right to provide feedback, comments, or responses to the Content creator through the reporting and feedback mechanisms available within the Service. Businesses may report Content that they believe violates their rights or does not comply with the Freeela platform’s guidelines.

Intellectual Property

  • The service and its original content (excluding content provided by you or other users), features and functionality are and will remain the exclusive property of our company. The service is protected by copyright, trademark, and other laws of Australia.

Location Data

  • We use location data to provide and improve our services. You consent to our collection and use of this information as described in our Privacy Policy.

Communications

  • By providing us with your email address, you agree to receive communications from us. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Third-Party Services

  • Our service allows you to link to third-party payment gateways that are not owned or controlled by Freeela. We assume no responsibility for the content, privacy policies, or practices of any third-party services.

Changes

  • We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

Governing Law

  • These Terms are governed by and are to be construed in accordance with the laws in force in the New South Wales Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales Australia and any courts which have jurisdiction to hear appeals from any of those courts and You waive any right to object to any proceedings being brought in those court.
